The 18-count charge preferred against a Federal High Court Judge, Justice Adeniyi Ademola, his wife, Oluwabole and Joe Agi (SAN), fell flat Wednesday, as FCT High Court dismissed all the counts and discharged the defendants.
In a judgment that lasted for two hours, trial Judge, Justice Jude Okeke, said the prosecution failed in its entirety to prove any of the charges against the defendants.
The Judge upheld the no case submission of defendants, saying the the case was based on speculations and high level of suspicion on the fight against corruption in the country
According to the Judge, speculations in the eye of law do not stand.
He thus tasked security agents to carry thorough investigation before arraigning an accused.
Justice Ademola was among the seven superior court Judges whose homes were raided by operatives of the Department of State Service, DSS, between October 7 and 8, 2016.
Ademola alongside his wife, were said to have received monetary compensation to pervert course of Justice, from Joe Agi, by so doing committed offences contrary to Section 8 of the Independent Corrupt Practices Commission Act , 2011 and Section 115 of the Penal Code Law .
The Federal Government had maintained that the offences were committed between Febuary 2014 and June 2016.
The defendants allegedly received N40m between February 20 and 21, 2014 and another N30m from Messers Joe Odey Agi and Associates between March 11 and 26, 2015.
Justice Ademola was said to have received N30m from Agi who is a Senior Advocate of Nigeria, between March 11 and 26, 2015, with his wife who is a senior civil servant with the Lagos state government, also pocketing another N30m from the same source to give a favourable judgment before the Ademola. .
The Attorney General of the Federation and Minister of Justice, Abubakar Malami, endorsed Charges against the accused
According to the prosecution, he had on May 6, 2013, received $520, 000:00 from Messrs Johnson & Johnson Solicitors and another N6m between February 25 and April 16, 2015. Justice Ademola was further alleged to have accepted N55, 650, 000:00 from Messrs G.T. J Ademola & Co between January 5 and June 23 this year.
It was further alleged that Justice Ademola on February 20, 2014 accepted N40m from Vertice Solutions Limited, as well as the another N47, 600, 000: 00 from Acardian Energy Services Ltd .
Besides, Federal Government alleged that th Judge had on February 20, 2014, accepted N34, 080, 000:00 from one Omotayo Babafemi Aliyu and N4, 771, 300:00 from Lawan Suliaman between February 21 and November 7, 2014.
The Judge also allegedly received a car gift through his son, Ademide Ademola, as gratification in the exercise of his official functions as a judge of the Federal High Court.
It was further alleged that the Judge was found in possession of guns and live firearms without a licence.
However, in dismissing the theory of conspiracy, the prosecution was not able prove that the defendants conspired to commit crime as preferred against them.
On the money recovered from Ademola’s home, Okeke said witnesses called by the prosecution could not establish that it was a proceed from a crime.
On the said money paid into the accounts of the Justice Ademola and that of his wife, the trial Judge also said prosecution witnesses when cross exami
